Terms of sale
Version 1.0 · 18 October 2026
These terms apply to surfboards, repairs and workshops ordered from Fajã Surf Labs, a brand of Sculpted Chronicles, Lda (NIPC 519412443, Avenida Marcos Marques Rosa, n.º 100 – Fajã da Areia Pico, 9240-040 São Vicente, Madeira, Portugal; "we"). Nothing here limits the rights the law gives you as a consumer.
1. How an order is made
- You tell us what you want, on WhatsApp, Instagram, by e-mail or in person. For a custom board that includes your height, weight, level and the waves you surf; we propose the board, its dimensions and volume.
- We send you a quote with the specification, the price in euros including VAT, the deposit, the estimated lead time and, for shipping, the delivery cost.
- The order exists when you accept the quote and, where a deposit is asked, pay it. The quote and these terms are the contract. Nothing on this website is an offer; the configurator, the free tools and the prices mentioned anywhere on the site are indicative.
- We may decline an order, for example when a request cannot be built safely.
2. Custom boards
- Every board is built to your specification. Dimensions and volume are confirmed on the finished board, measured in the lab; hand-shaped boards may differ from the quote by up to ±3 mm in width and thickness and ±0.5 litre, which is normal for a handmade product and is not a defect.
- Changes you request after the blank has been cut may be impossible or may change the price and the lead time; we tell you before going on.
- Lead times are estimates. Blanks, resin and fin hardware depend on suppliers in mainland Europe; we keep you informed of delays, and a delay by itself does not give a right to cancel unless it exceeds 30 days beyond the estimate, in which case you may cancel and receive your payments back.
- Boards are collected at the lab in São Vicente unless shipping was agreed in the quote. Risk passes to you when you or your carrier receive the board; when we arrange the carrier, risk passes on delivery to you.
3. Repairs
- We assess the damage from your photos or in person and quote the repair. If, once the board is opened, the damage is larger than it looked, we tell you the new price before continuing; you may stop the repair and pay only for the work done so far.
- A standard repair restores the board's structure and leaves a clean, sanded finish in clear or white. Colour matching, tints, pigments, artwork and gloss finishes are extra work, quoted and charged separately when you ask for them. Even then, a match on an old or faded board is as close as the materials allow and is not guaranteed to be invisible.
- Boards left at the lab must be collected within 60 days after we tell you the repair is done. After a reminder and a further 30 days we may charge storage or treat the board as abandoned, as Portuguese law allows.
4. Workshops
- A place in a workshop is confirmed when the deposit stated in the quote is paid. The materials for the board you build are included where the quote says so.
- You may cancel up to 14 days before the start and receive your payments back; a later cancellation forfeits the deposit unless we can fill the place. If we cancel (for example, too few participants or the shaper's illness), you get everything back or a new date, as you prefer.
- Workshops involve power tools, dust and resin. You follow the shaper's safety instructions and wear the protective equipment provided. Participants must be 18 or older, or 16 with a guardian's written consent.
5. Prices and payment
Prices are in euros and include Portuguese VAT at the rate applicable in Madeira. A deposit is usually 50 % for custom boards and 100 % for materials ordered specially. The balance is due before collection or shipping. We accept bank transfer and the methods stated in the quote; we issue an invoice for every payment.
6. Right of withdrawal
If you ordered at a distance (WhatsApp, e-mail) as a consumer, you normally have 14 days to withdraw from a contract without giving a reason (Decreto-Lei n.º 24/2014). This right does not apply to goods made to your specifications or clearly personalised, such as a custom surfboard (art. 17(1)(c)), nor to a repair or workshop that has been fully performed with your prior agreement. For a workshop booked at a distance, you may withdraw within 14 days of booking unless it has already taken place; the cancellation rules in section 4 apply after that.
7. Legal guarantee and defects
Goods we sell to consumers come with the legal guarantee of conformity of 3 years (Decreto-Lei n.º 84/2021). A repair carries the legal guarantee for consumer services, 2 years, and it covers only our workmanship on the repaired area: a patch that lifts, lets water in or fails without any new impact. A repair that has been hit again is not covered, even if it opens at the same place; a new impact is a new repair, quoted again. Impacts leave marks (crushed foam, cracks, a dent), and we assess every returned board before deciding. Workshop services carry the guarantee the same law gives to services.
If a board or repair is defective, tell us and we repair it, replace it, or, where that is impossible or disproportionate, reduce the price or refund you. Normal wear, pressure dings, damage from impacts, heat (boards left in a car or in the sun), delamination caused by misuse, and damage caused by a later impact are not covered.
8. Liability
- Surfing is a sport with risks. A well-made board does not make it safe, and you surf at your own risk.
- If something we did wrong causes damage, we answer for it, as the law requires. We do not try to exclude that.
- We do not answer for losses nobody could reasonably foresee, such as a missed trip, contest or booking because a board was late or broke.
- We do not answer for damage caused by using the board, or the skills learned in a workshop, in a way we advised against.
9. Your design and our work
The design of your board, including the file we draw in ShaperLab Pro, is ours; you receive the board, not the file. You may ask for a copy of the spec sheet. We may photograph the boards we build and show them on our website and social media; we show your name only with your consent.
10. Complaints, disputes, law
Tell us first, at fajasurflabs@gmail.com or on WhatsApp; most things are solved in a conversation. You may also use the electronic complaints book at www.livroreclamacoes.pt and the alternative dispute resolution body named in our Legal notice. Portuguese law applies; the courts competent for consumers are those of your residence.
11. Changes
We may update these terms for future orders. The version in force when you accept a quote applies to that order.
